DRUG ENFORCEMENT AGENCY NPO internal Mandate and Organizational Code of Conduct:
Purpose
This Code of Conduct establishes the ethical standards, operational principles, and professional responsibilities governing all members, volunteers, affiliates, and representatives of DRUG ENFORCEMENT AGENCY NPO.
Our organization is committed to lawful conduct, accountability, integrity, and respect for human rights in all activities.
Legal Compliance
All members shall:
Operate strictly within the laws of the Republic of South Africa
Respect and uphold the Constitution of South Africa
Act in accordance with the Criminal Procedure Act and all applicable legislation
Co-operate fully with the South African Police Service (SAPS), the Directorate for Priority Crime Investigation (DPCI – Hawks), and other recognized law enforcement authorities.
Under no circumstances may any member act beyond the legal authority permitted and governed by Section 42 of the Criminal Procedure Act 51 of 1977
Ethical Standards
Members must:
Conduct themselves with honesty and integrity
Avoid corruption, bribery, or conflicts of interest
Refrain from abusing authority, position, or access to information
Avoid conduct that may bring the organization into disrepute
Zero tolerance applies to any form of criminal conduct, corruption, or unethical behavior.
Respect for Human Rights
All operations must respect:
The dignity and constitutional rights of all individuals
The presumption of innocence
Protection against unlawful detention, harassment, intimidation, or discrimination
No member may use excessive force, intimidation, or unlawful methods in the performance of duties.
Professional Conduct During Operations
During operational activities, members shall:
Identify themselves appropriately where required
Avoid unnecessary confrontation
Preserve the integrity of crime scenes
Immediately report serious criminal matters to the appropriate authorities
Maintain accurate and truthful records
Members may only detain individuals where legally permitted and must immediately hand such individuals over to the appropriate authorities.
Confidentiality
Members shall:
Protect sensitive operational information
Safeguard personal data
Avoid unauthorized disclosure of information to the media or public
Share intelligence only with authorized law enforcement bodies
Breach of confidentiality may result in disciplinary action or legal consequences.
Conflict of Interest
Members must disclose:
Any personal, financial, or business interest that may conflict with their duties
Any relationship that may compromise impartial decision-making
Failure to disclose conflicts of interest constitutes misconduct.
Prohibition of Unauthorized Representation
No member may:
Present themselves as a member of SAPS, DPCI, Metro Police, or any state law enforcement body
Wear uniforms, insignia, or use identification when on duty
Issue official statements without proper authorization
The organization operates independently and supports, but does not replace official law enforcement agencies.
Reporting Misconduct
Any member who becomes aware of misconduct must report it through the appropriate internal channels or to relevant authorities.
Whistleblowers acting in good faith will be protected from retaliation.
Disciplinary Measures
Violation of this Code of Conduct may result in:
Suspension
Termination of membership
Referral to law enforcement authorities
Civil or criminal action, where applicable
